The legal concepts codify our understanding of justifiable and unjustifiable killing. They didn't invent it.

I think the mistranslation is probably better overall because some people will feel justified in killing someone while (most) others will feel they just straight up murdered them.

Though I do think it being a mistranslation makes sense. You should be allowed to kill in self-defense or in (immediate) defense of others. Otherwise others who have no problem killing/murdering will exploit your unwillingness or hesitancy.

Legal definitions can and often don't match colloquial definitions.

Thou Shalt not kill could be interpreted like a jainist where you literally cannot kill anything. Thou shalt not commit murder just means don't kill other humans.

Wouldn't this actually affect Islamic countries more? As I'm aware some of them actually do have laws that outlaw killing even in self defense (of course, they themselves can execute because they speak for Allah or whatever)

Not a mistranslation exactly, but just a translation for people who spoke English 400 years ago. Presumably, "thou shalt not kill" would have been interpreted a little differently by the target audience.

I think "murder" is a better translation for today but still holds a some ambiguity. After all, in the US judicial system, the same term is used for first through third degree "murder." While I think in the public consciousness, that's not always true.

Anyway, the idea is that you don't unjustly take a human life. There are cases in the OT where God instructs people to kill not just animals but humans too. Israel is at times instructed to go to war, for example.

And then there was King Agag, whom Saul was supposed to execute but instead took as a POW, prompting the prophet Samuel to draw a sword and behead the guy himself. Failure to do as instructed by killing the guy was actually the offense that cost Saul the kingdom. He died in battle and was not replaced with his own heir but with David son of Jesse son of Obed son of Boaz the husband of Ruth.

Humans definitely invented the concept of murder. Murder in itself is a concept that varies based on a countries legal system, who is doing the killing, and who is the authority that gets to classify it as lawful.

For example when a cop kills people, legally speaking it more times than not doesn't get classified as murder in the courts because it gets classified as a lawful killing. Even when we the people would most certainly call the cops unjustified, and in our opinions should be unlawful. The people don't get to classify it as murder (unlawful killing), only the stronger authority does which tends to be the government.

Or easy low hanging fruit examples of senseless death of countries or groups killing other groups of people they deem lesser humans. But the former views themselves as not murderers, and history showed was well within their laws to kill, therefore not being labeled unlawful.

Given the fate of Canaanites -- no.

If God says "don't kill" and then, shortly thereafter, commands "his people" to genocide , then the commandments are always gonna be a little bit fuzzy.
