https://people.com/take-care-of-maya-trial-hospital-found-liable-mothers-suicide-munchausen-by-proxy-accusations-8400157

A girl was forcibly taken by a hospital. The mom was accused of making up the girls illness, illness was called fake. Family lost contact with daughter and hospital workers, judges and CPS worked together to essentially pull off a kidnapping. The mom eventually killed herself in despair.

Eventually the hospital finally let the girl go but they charged the surviving dad, fees for treatment of the very illness they said was fake. The girl is now grown. She's like 17 or 18 now. She, her brother and dad sued the hospital. And she won today. Hospital was found guilty and liable for ruining a family. And has to pay millions of dollars to the victims

Good. It won't bring her back, but I'm glad they were held accountable.

I haven't seen the documentary's, but where was the malicious intent here? It seems the hospital staff thought there was abuse going on at home.

The hospital themselves abused the girl. One thing they did, amongst other things, was accuse the girl of faking her condition. They put a toilet bed pan or whatever it's called, just far enough away from her bed that she would have to walk to it

And they left a camera watching to catch her getting up, which they expected her to be able to do even though her condition made that impossible. Instead, the girl just wet the bed because she couldn't get up

Also one of the CPS ladies told her, that she would be her new mother. This was before her mom was even dead yet. It's very creepy and inappropriate

These are hard cases.

Munchausen's by proxy is a real thing. If the diagnosis was made in good faith, they acted properly.

An undiagnosed case, and the public would be rightly outraged too.

My point is they didn't settle this out of court. I suppose the family wanted it to go to trial, but the hospital should have kept adding digits to their offer until they kept it out of court.

Letting it go to trial was a mistake on their part.

I know it's hard to believe but there's more to life than money. Justice is important too. But not having this go to caught the hospital would have been able to claim there was no wrong doing. At least now it opens up the doors for other people to come forward for other instances like this which there almost certainly will be.

You know CPS service is a state government program right? And we are absolutely required to report it by law if we suspect it. We don't need proof.

The SCR receives calls 24 hours a day, every day from two types of sources: persons who are required by law (mandated) to report suspected cases of child abuse and maltreatment; and calls from non-mandated reporters, including the public.
Among those who are mandated reporters:
  • Medical and hospital personnel
  • School officials
  • Social service workers
  • Child care workers
  • Residential care workers and volunteers
  • Law enforcement personnel
https://ocfs.ny.gov/programs/cps/

Also,

While there, hospital staff reported Beata to the Department of Children and Families after she requested Maya be treated with ketamine, saying the drug had helped her daughter in the past.

Uhhh.....What......the....fuck.....We give addictive pain meds to children now?

Ketamine infusion Systematic reviews have found that there is only low- to moderate-quality evidence supporting the use of subanesthetic doses of ketamine for CRPS [8,30,53-55]. In one of the higher-quality randomized trials, ketamine infusion was compared with placebo in 60 patients with type I CRPS [56]. Patients assigned to five-day ketamine infusions had a statistically significant decline in pain scores from weeks 1 through 11 of follow-up compared with the placebo group, but the reduction was no longer statistically significant by week 12. Frequent side effects of ketamine in this trial included psychomimetic symptoms (eg, hallucinations, delirium), nausea, and vomiting.

Ketamine is not some evil substance. It has legitimate medical uses, tho can be addictive, same as other prescription painkillers. I can understand hating opiates AND ketamine, but one is not significantly worse than the other

today you learned meth can be prescribed to children

EDIT: btw the point Im trying to make here is that drugs have all kinds of medically accepted uses and just because something can be abused as a street drug, doesnt mean it cant be used in a positive way

Becaise the internet sucks at inferring tone. If you think that I'm on the side of the hospital, you're out of your fucking mind. The hospital's legal team was not wise and I was laughing at how they let it get this far.

But if the family wanted it to go to trial that's another story. Still laughable on the legal team's part.

With the kind of sickle cell pain crises episodes I had as a kid, I would be way the hell worst off or possibly dead had I not got "addictive pain meds" alongside everything else that helps with either help preventing the pain crises from starting and controlling the pain when it inevitably happens. Usually the stronger stuff is reserved for when you actually go to the hospital compared to the at-home pain medicine. For me personally something like oxycodone and morphine sulfate is only taken when needed, but if I ever get into a pain crisis that my home medicines just isn't cutting it (normally happens when the weather gets cold as balls) then a trip to the ER and a IV set-up with something like dilaudid is normal for sickle-stuff. (Yeah, I was used to this kind of thing w/ a pain pump as a kid).

For some of us chronic pain patients, yeah, stronger meds really is a life-long thing. It doesn't necessarily mean you become addicted to them though (although it actually can happen, but majority of us life-long chronic pain peeps are responsible with this kind of thing).
