But it's not his fault the stadium walls were too low, probably illegally so, or that the tshirt gun shooter boobie girls was negligently careless.

Further Homer would most certainly be declared unfit to stand trial anyway, in a real court at least, even if you think you can argue that he ought to have known in that split second of compulsion that his actions might result in danger. Which I don't think you can argue.

That said his lack of remorse afterwards is kind of gross.
