I hope something comes from this. They're appealing all of them, including Stewart Rhodes' 18 year sentence (they wanted 25 for him), but some of them got like 3 years for seditious conspiracy. Ridiculous.

Good they deserve the maximum sentences. In any other healthy democracy capitol punishment would be on the table.

Lots of healthy democracies (healthier than the US) don't have capital punishment.

Didn't say it was. I was responding to TK's assertion that any other healthy democracy would have capital punishment available despite most healthy democracies not having it.

of course it should, or any corrupt/bought judge could just give minimum sentences for everything without scrutiny

If a sentence falls within sentencing guidelines and was a fair trial, then the government shouldnt be able to go, Well actually, we want them in there longer.

It just seems wrong. The trial was held, they were convicted and sentenced. Where do we draw the line? You serve your sentence without issue and are expected to be released on time. Some prosecutors petitions to keep you in longer because they feel like you werent in there long enough.

I feel like this already happens enough as is, especially for Black defendants.

it's just an appeal the same way a defendant would appeal to get a reduced sentence. it's not a guarantee even if it's coming straight from the DoJ

It's pretty rare, mostly because judges usually follow the sentencing guidelines set out in law. The judge in this case giving a sentence well below the minimum is pretty much the only circumstance where the prosecution can appeal a sentence.

But the prosecutors word has weight that will cause a judge to seriously reconsider.

I guess I just believe in a separate of power in the government, which keeps any one entity from wielding unilateral power, if not in name, in function.

A cop arrests. A prosecutor prosecutes. A judge sentences. Once you do your part, move on.

Most of these were well below the guidelines. The 18 year one is arguable.

Edit: the statute says "not more than 20 years" but that doesn't make 3 years a reasonable outcome.

In my book, sentencing starts at 15-20 for something like that.
