Yeah, it's likely this really was a misinterpretation. To completely overhaul the format it's going to be on would probably cause another delay.

it was always listed that the constellation edition was a digital download while the others were a physical disc.

They easily could have. It's still nearly 2.5 months from release and the game likely won't "go gold" until early August. That's plenty of time.

Doubt it. You have to secure all kinds of deals and whatnot way ahead of time.

The disc contains poison, the day0 patch contains the antidote. This is how Microsoft's done business since Windows XP.

What "deals"? Both Microsoft and Bethesda are major publishers who are capable of handling all distribution set-up in-house. It's not like we're talking about some small indie dev here that needs to have a third party publish their game.
