"Three conservative appeals court judges, each with a history of supporting restrictions on abortion, will hear arguments May 17 on whether a widely used abortion drug should remain available.

The case involves a regulatory issue whether the Food and Drug Administrations approval of mifepristone, and subsequent actions making it easier to obtain, must be rolled back. The appellate hearing follows an April ruling by a federal judge in Texas, who ordered a hold on federal approval of mifepristone in a decision that overruled decades of scientific approval. His ruling was stayed pending appeal. The case was allotted to a panel made up of Jennifer Walker Elrod, James Ho and Cory Wilson.

The three judges of the New Orleans-based 5th U.S. Circuit Court of Appeals wont rule immediately. Their decision, whatever it is, is also unlikely to have an immediate effect pending an expected appeal to the U.S. Supreme Court."

Inching towards a national ban on abortion pills. Supreme Court favorability will take a hit if the right leaning branch continues to limit abortion rights.

"The legal battle over mifepristone, one of two medications used to provide abortions and treat miscarriages, continued Wednesday when a federal appeals court heard arguments about access to the drug.

The lawsuit over mifepristone dates to November 2022, when a group of abortion rights opponents filed a complaint alleging that the Food and Drug Administration had acted improperly when it approved mifepristone in 2000 and later expanded access to the drug by loosening regulations and allowing it to be dispensed via telehealth. Mifepristone is now used in more than half of abortions nationwide.

Over the course of two weeks in April, the immediate future of access to mifepristone was thrown in sudden jeopardy when U.S. District Judge Matthew Kacsmaryk issued a preliminary injunction undoing the drug's FDA approval. Ultimately, the Supreme Court issued an emergency stay, allowing mifepristone to remain widely available.

Among the plaintiffs are several doctors who said they had been "forced to participate" in abortion, against their conscience, when patients sought emergency care after taking mifepristone. "They allege that they feel complicit in an elective abortion by being forced to complete that procedure," said Erin Hawley, a lawyer bringing the suit against mifepristone."

A bunch of doctors who want to give medical advice based on religion. Religion entering the medical profession is dangerous shown with bills that allow doctors to not give care to LGBT patients.

BTW, the Texas judge who "overturned FDA approval" of the drug is a supporter of fetal personhood. For the unaware, Fetal Personhood refers to supporting constitutional rights for fetuses and fertilized embryos. It would have disastrous consequences on womens' freedoms (could potentially ban the birth control pill, limit what medications women of childbearing age can take, and make it illegal for women of childbearing age to consume alcohol, or to provide/serve alcohol to women of childbearing age. Obviously it would also ban IVF fertilization and any form of embryonic stem cell/tissue research that doesn't involve pre-existing immortal cell lines. Seriously.)
