Nintendo said he cost them 14.5 million$. He currently pays 25$ monthly from his prison wages. After his release he has to pay Nintendo 25-30% of his income. How is this legal lmao.

While Nintendo has the right to go hard on this guy and it was certainly done with the intent of sending a message (there's no way Nintendo realistically expects to actually get $14.5m from this guy over the course of the remainder of his life, considering most people don't make anywhere near that much in their entire lifetimes even counting 100% of their income), I feel like going this hard on him is not going to send the message that Nintendo is hoping for.

I fear it's going to embolden the hacker-resellers rather than intimidate them, and to everyone else it's running the risk of making Nintendo seem, well, a little douchey. But then again, Nintendo already had that kind of reputation with regard to cracking down on any perceived affronts to their IPs, I guess.

He was charged in accordance with copyright law. $150k for copyright violation and $2,500 per device. That definitely doesnt need to be less. I dont support leniency for people who fuck themselves and are left prospectless after a life of crime catches up to them.

Theres an assumption I keep seeing online that this dude was a boon to the community and did all of this for free and to spread the love of Nintendo classics.

Hes a multi-decade criminal, and his $175 in restitution over a 3 year jail stay should let you know you're dealing with a stupid fuck.

Oh no, I'm supposed to feel bad for a company that thinks it's beneath them to lower prices on their games.

Also, he was involved in selling modchips. Not roms. All modchips do is basically root your device. If people want to pirate, that's on them. To figure a $14 million loss on that is complete BS.

Now that I think of it, that could be how Bowser keeps getting let off the hook rather than imprisoned by Mario/Peach every time he's defeated.
All those coins that Mario collects throughout his journeys (including in the RPGs where all enemies drop coins) are actually all Bowser's and so Mario/Mushroom Kingdom gets compensated with all that coin and Bowser gets to go free.

Nintendo separately filed a civil lawsuit against Bowser in April 2021 related to three counts of copyright infringement, seeking damages of $2500 per trafficked device, and $150,000 for each copyright violation.[9][10]
Nintendo has also successfully prevailed in other lawsuits involving resellers of Team Xecuter devices.[11]

i actually know of a small website that had roms on it
that small website actually got a C&D letter from square enix ordering to take down the SE roms it had
but the thing is the site wasnt told they had to take down all the SE roms. just the final fantasy and live a live roms

which is how i knew the live a live remake and pixel remasters were coming before they even existed
now just to be clear i didnt use the site to get roms as i have moral fiber and would never comment such a morally bankrupt act like use a rom to play a japan only game from 30 years ago!!
