A 17-year-old Florida student caught on video beating a female school staffer unconscious after she confiscated his Nintendo Switch video game device will be charged as an adult as it emerged that he has previously been arrested for battery three times.

The 6-foot-6 teen has been named for the first time as Brendan Depa after the Seventh Judicial Circuit Court ruled that he would be tried as an adult with aggravated battery on a school board employee, the Daytona Beach News-Journal reported.

The first-degree felony is punishable by up to 30 years behind bars, according to the outlet.

Depa did actually and intentionally touch or strike (the victim) against the will of (her) and in doing so used a deadly weapon, and/or intentionally or knowingly caused great bodily harm, permanent disability, or permanent disfigurement, the State Attorneys Office said, according to Click Orlando.

Meanwhile, it has emerged that Depa was arrested three times for simple battery in 2019, when he lived in Riverview in Hillsborough County, where his mom is an occupational therapist, Flagler Live reported.

The arrests were categorized as first-degree misdemeanors.

After his first arrest in March that year, he was placed in juvenile custody for a few days but was soon rearrested and admitted to what the state Department of Juvenile Justice refers to as respite care, according to the outlet.

He was reportedly held for domestic violence respite care, which the department defines as When the youth being admitted was screened at the JAC [Juvenile Assessment Center] for domestic violence charges and did not score for secure detention, but is unable to be released to family and would otherwise be held in secure detention. ...

just throwing around ideas here but if the kid failed the class it might come back to the teacher since they are the ones accountable in making sure the kids aren't distracted

Isn't whether someone is tried as a juvenile or an adult taken on a case-by-case basis that factors in both the severity of the crime and also the degree to which the person might have been aware that what they were doing is criminal?

I don't know that it's based around how pissed off we are, but I'm sure there's a correlation between the level of pissed off and the severity of the crime that just happens to align nicely with the criteria they consider.

This isn't a 10 year old that pushed his teacher. It's a 17 year old that knocked them unconscious and then kicked them repeatedly while they were down. A 17 year old that has been charged with battery multiple times.

I went to school once. Other kids playing on their phones didn't affect my education. The teacher stopping teaching to argue with them and try to take their shit is what affected my education. Literally just saying to leave those problem kids to their own devices and everyone will be better off

also It's likely the kid is gonna plead some sort of mental health issues. probably land a couple of years in some minimal security mental health facility.

As he should if there are mental health issues. Which does seem more likely than not, but who knows.

Either way, it would seem that giving a real attempt at rehabilitation for someone so young is probably the moral onus. And that's not going to come from a 20 year sentence.

a lot of mental health facilities are basically jail.
you need permission to even go outside and somebody like him will probably be constantly supervised. somebody with mental issues shouldn't be in actual jail where he's going to get brutalized in various ways. people with mental problems don't do well in real prison

most mental health facilities have foresenic waitlists off the charts due to constant short staffing. thousands of people already deemed unfit to stand trial in every major city are being housed in jails and prisons where pysch care is non existent.
