Sidewalk and went through the cross walk i finally speed up because he was going well under the speed limit and I was stuck behind him. But nope, other side of the cross walk he whips back out onto the road without looking right in front of me accelerating I brakes hard and eventually just swerved around him but if I had ran him over, would I have gone to jail? My understanding is that the cyclist is a vehicle, not a pedestrian. It would really depend on the specifics of the situation, but the fact that he veered out of traffic into a place that he shouldnt be, and then seemingly cut you off, would possibly put him at fault.
