I just read an article on a new legal scholastic philosophy called "common good constitutionalism" which is basically legislating from the bench to implement actions without cause for whether "the freedom of the individual" is being affected.

That shit is fucking horrifying. The legal theory equivalent of intelligent design.

After the Trump disaster, "conservatives" are splitting between evangelists and Rand loons.
This is what should have happened decades ago, but it's turning out wrong.

This isnt a new idea from the right. Just look at Missouri and abortion and other states taking abortion off the vote after Missouris vote.

It also happened many times in the past.

What Im referring to happened years ago. Im looking for it. The Missouri enshrining abortion causing other states to take it off the ballot was what I was talking about for that state.

Youre literally being too focused on Missouri when thats not what Im talking about... literally the only thing I said was that they passed their abortion protections and it caused other states to try to take it off their ballots because they expected Missouri to outlaw abortion and didnt. So they didnt want voters to have a say in their states to say the same thing.

At this point the GOP think they know what is best for "the people."

any politician proclaiming "common good" should never be trusted.
