Dr. Caitlin Bernard, the Indianapolis obstetrician-gynecologist who provided an abortion to a 10-year-old rape victim from Ohio, is suing Indiana Attorney General Todd Rokita, alleging he has relied on "baseless" consumer complaints to launch "overbroad" investigations into physicians who provide abortion care, and issued subpoenas seeking the confidential medical records of their patients

Hope the AG's ass gets fucking dragged.

I really do.

Because if it doesn't, then we're building to a hell of a precedent.

Don't AG have qualified immunity on their side? Pretty sure this suit will go nowhere.

Doesn't apply here since he misused his power.

Who determines that, the person he's investigating and their lawyer? That makes no sense at all.

probably another court or another branch of the court. There has to be some way to hold them accountable.

That would probably be through legislation or through executive action. It definitely wouldn't come about because the person that's being investigated said that overreach occurred, that's why qualified immunity exists in the first place.

Good, and the AMA and ACOG should fully support her financially and politically.

hopefully theres someway to keep them accountable. Otherwise, they can just use qualified immunity to get away with anything overreaching.

Most AGs are elected, that's how you keep them accountable. Once they're in then they can do whatever they want so long as they're acting within the bounds of their profession. If the AG of Ohio is able to issue a subpoena for medical records then that's an issue that needs to be resolved by legislation. This lady is wasting her time and her money.
