Senator Josh Hawley has proposed a bill that could see Disney lose the copyright for the original Mickey Mouse, as it would reduce copyright protections from 95 years to 56. Hawley specifically noted "it's time to take away Disney's special privileges."

This is...

kind of one issue I agree with the Republicans on. I know they're doing it deliberately to fuck Disney. But still. Everyone else had to play by the same rules. You get a character or concept for 80 years, then it becomes public domain. Now there are all these loopholes. You get to keep the character if you have a consistent movie series. You get to keep the story if you release a video game in time.

To me, it seems like those laws either need to be set in stone or else we need just do away with the public domain altogether. Let the estate of Sir Arthur Conan Doyle get exclusive legal rights to Sherlock Holmes. Let the estate of Edgar Rice Burroughs keep Tarzan. Host public auctions to see who gets to own the exclusive rights to Robin Hood, Hercules, and other characters for whom the rightful author is untraceable.

I'd like to use a strict interpretation of the constitution here. Article 1 section 8 clause 8 specifies:

To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries

And nowhere does it say those rights are transferable. Disney shouldn't have been allowed on a conceptual level to buy the rights to Star Wars from George Lucas.

For the record, I think Disney has been preparing for the possibility of losing their copyright on Mickey.

Over the past few years, they've gradually been phasing Mickey out or relegating him to Disney Jr. content. By the time you're legally able to sell t-shirts with severed Mickey Mouse heads or make a cartoon short where Mickey goes Grand Theft Auto and snorts coke off of a hooker, all you're really going to have robbed Disney exclusive rights to is their version of Barney the Dinosaur or Kermit the Frog. "Oh, no. Not our Disney Jr. mascot. What will we ever do?"

See idk as a creator to an extent I do find the notion of public domain to be murky in the sense if I had characters that I made money off of but then I have them released to the public for anyone to mess with that means Inmost likely could lose out on money or my characters images could be damaged so I can see why Disney were pushing to extend copyright.

What I dont think should be legal is copyright on essentials.

Those are protected by patent not copyright and you should be able to have those but you should also be forced to license them to be made available where needed kind of like what the FCC does with cell towers.

Got mixed feelings on this.
I'm a purist in the sense, I want to see an accurate, original work, and these "neverending" characters or stories get so muddied from their source that you end up with shit like Spider-Man making a deal with the devil, Frankenstein's monster being depicted as a mute green giant instead of an eloquent tortured soul, Tarzan as a dumb ape man instead of a force of nature that taught himself to read etc. You can and should take inspiration from media you like if you're an artist/writer/filmmaker/game designer/whatever, but having to mess around with someone else's creation just reads as disrespectful or lacking ingenuity to me.
So 9 times out of 10, the OG story from the OG person(s) is the only thing that I care about taking in.
That being said I could not possibly care less if the multi billion dollar corporation that sits on these properties and corrupts them so far beyond their original idea that they end up "in name only" gets hit, screw em.

There's a lot of issues with American IP law, but I'm not supporting Republican petty spite, just to change it. Disney shouldn't be allowed to undermine or influence the Florida government, but if anyone truly cared about that, we'd outlaw lobbying.
