Since I've handled litigated claims starting in Nov 2019 I haven't had one go to trial.

My first one just finished and I won. The pltf wanted $3.5m, our final offer the day before trial was $90k.

The jury came back with an award winning of $52k and the plaintiff's attorneys are surely going to end up in the red on this matter. Idk why they decided to take this case this far but it feels neat to have my first trial end in a win.

I'm sure someone crunched the numbers and figured out that, while they may lose money on some cases, on average it is a profitable line of business.

It didn't matter much for the attorney's probably and they sold the idea to their client because the diff in how much they got between a 90k and 52k payoff (guessing it was contingency based so a %) was small. Even if they lost completely and the other side got attorneys fees, the plantiffs attorneys would not have lost much, but if they got a big payout of 3mill or more, they would have gotten a ton.

It's sad if the case was real as the plantiff in such situations usually gets totally screwed due to the attorney's being greedy and it's a big reason why contingency cases are often dangerous.

Even 90k which would have been the settlement would have basically doubled the plaintiffs payout, which could be a big deal if they had medical bills etc. For a filed lawsuit contingency is usually 40%, so the plaintiff could have gotten 60k or so straight up with the settlement, and is now only going to get around 30k instead. The lawyers lost a bit as well, but honestly it's all green for them as they probably spent almost no time in court and just filed a few papers, so they get 20k for less than 10 hours or work more than likely, still netting 1k per hour.

Sadly that is how contingency cases usually work, the attorneys are out for their own paychecks and don't put the clients interest first.

Wolfy. Lmao. This firm hired tens of thousands of dollars in experts to try to peddle that this woman has a TBI. I paid $11k alone for one expert. Like there is no way they made out.

She tried to have a chiropractor be her medical expert to diagnose her TBI so he def got paid well already

thats pretty lazy on her lawyers part if all they could get was the chiropractor for that. i use an mri group who supposedly specializes in brain images to prove tbi for auto accidents but if they didnt have a true neurologist or any imaging to back up the claim, you were right for calling them out on it and pushing for trial. good for that dude getting paid though lol

Yeah I paid an expert $10k just to TESTIFY at the trial. That was after her fee to do the IME and record review.

This woman had a doctor that had written in a medical record that she said she's been to 4 doctors and he's finally the first that agreed with her she could have a TBI

Way to incriminate her doctor shopping in writing. Then he testified on her behalf lmao

Pltf counsel's last demand to us privately was $165k and the next day at trial in their opening they asked the jury for $3.5m. It was done for them from that point.

im sure he was going for something along the lines of she saw three others doctors and im the first to properly identify the true extent of her injuries which sometimes (rarely) can be true but speaks more of his own inflated ego and the weakness of their claims. if they didnt have any type of third party objective evidence/imaging to back up his claims, thats just dumb on the lawyers part to ask for 3.5 million and not jumping on some smaller settlement

Defense counsel reported that asking for that much evoked a physical reaction from the jury that we knew they weren't going to be able to fulfill.

that's interesting. watching a lot of car accident videos there are quite a few where the accident seemed almost harmless but the cammer says something like "had substantial neck and back injuries".
