Different motivations can play a role in how likely somebody is to re-offend, so they should be considered in assessing the risk they present. Whether or not that applies to this specific case is up for debate, but there's nothing wrong with the idea in a general sense.

i guess you can argue that probability falls within the general risk of causing harm, but i agree that likeliness to reoffend aligns with general risk to the public.

I think it would depend on the crime. Maybe for violent crimes? But that kind of motive would be rather difficult to prove unless the person confessed to it, and if it came with stiffer penalties, I don't think most people would.

I would say that the laws do express what rights one DOES have in terms of using property, so it lets them know what is permissible

copyright laws protect the user from misuse of media they are creating, and lets the community know what is, and is not protected should they create their own media for public use.
