Single Mother, Melissa Henderson from Georgia faces ONE YEAR in PRISON after she let her 14 y/o daughter BABYSIT her siblings while she went to work cause the daycare centre was closed down during COVID in 2020 as some call her actions reckless while others defend the desperate mother!!

She's a Mom of FIVE who is caring for her kids all on her own and is charged with criminal reckless conduct after she let her children under the care of her 14 y/o daughter, Linley, in May 2020 when COVID shut down the daycare centre

Linley had online school and didn't notice that her 4 y/o brother, Thaddeus had slipped out of the house when he saw his friend outside and went to play with him in Blairsville

Within 15 minutes she noticed him gone and found him at his friend's house down the street but the friend's mom already called 5-0 and Henderson was asked to come home and police took her statement. 2 weeks later they returned and ARRESTED her in front of her kids

Officer Mark Pilote said that anything terrible could have happened to Thaddeus after leaving home including being kidnapped or bitten by a venomous snake

Henderson sobbed and said she has no words on how low she feels now and at the bottom of her heart she is a good mother and wold do anything for her kids and to be handcuffed in front of them was the worst feeling in her life.

She remembers curling up in a ball in a corner and wanting to hide as her ex-husband had to bail her out

Her attorney, David DeLugas argues the charge is unconstitutional and is asking it to be dismissed and argues that Georgia's own child protective guidelines say children can babysit at the age of 13 with a parent's permission

But Georgia Division of Family and Children's Services said Thaddeus was left home alone before and she was given a warning even though they found no wrongdoing

They also said Linley had some measure of a LEARNING DISABILITY with ADHD making her unreliable as a sitter despite her having a GPA of 4.45 and was vice president of the 4-H Club and broke school records in varsity track and completed CPR program at a Red Cross Childcare Program

Officer Langley says it's unlikely a guilty verdict will land her in prison but he wants to keep the community safe and that her teen daughter, no matter her legal age to babysit will not suffice anymore

If convicted she faces 1 year in the bg house and a fine of $1000 as a gofundme was set up and Henderson has not returned to work since

The best way to help these kids is to ensure they grow up in a broken family, with a mother who can no longer get a job or hold one down (due to a criminal record) and learn to despise the justice system and police as early as possible.

What a waste of the Court's time.

14 year olds can babysit their sibs for a few hours, as long as you know they're responsible enough. How lame is it, she's going to jail for that? Although it does not sound like the daughter was responsible anyway, if the kid got all the way down the street before she noticed.

She has an attorney, the charge is ridiculous, and its now in the national news. The charges will either be dropped or she will get probation.

I know grown-up adults who have gotten into legal trouble because they fell asleep/passed out and the kids got out. You will get into trouble in every state if a little kid you're supposed to be watching is found wandering the streets.

Latchkey kid here! Coming home to an empty house was typical for me. I could take care of myself so long as mom and dad cooked dinner beforehand, or had something I could microwave.

Anyway, this charge is bullshit. Single parents have it hard enough as it is. Wouldn't be surprised if at least one of those cops who think women should always be married and submissive.

Lol ridiculous. My first babysitter was no older than 14 when I was a kid. As mentioned above, lot of times when I was only 10 or 11 I got off the bus and was home alone for a few hours til my mom got off work.

Man, I remember my parents living me home alone when I was like 7 or 8 for the first time.

Anyway, at 14 I was watching my younger brother after school for a few hours a day. This is ridiculous but also too much for a 14 year old in school to handle. Why didnt the mom call the 14 year old in sick to at least get her out of her school responsibilities so she could focus on the kids? Better yet, why didnt the mother call in sick?

My friend left his 7 year old home by himself one time. He was playing fortnite. My friend was going to mcdonald's real quick. He didn't think his kid was gonna stop playing. He was gone about ten minutes.

Got back home, back door is open, kid is gone. My friend frantically knocked on neighbors doors but couldn't find his kid. Finally called the cops. They had him. Somebody had seen the kid walking down the street with no coat on. Gave him a coat and called the cops. Said he "went looking for" his dad. The cops brought him back home, and DID NOT charge my friend with anything.

I can't believe they're charging this lady and not charging my friend.

The Union County District Attorneys office says while it understands Hendersons difficult situation, it says this is the second complaint the child wandering outside alone and that a warning was issued the first time.
DeLugas said the first incident has no relevance to the second one because each time, he feels Henderson did not commit any crimes.
