I mean I get why the family would be upset. But weren't they sentenced to life in prison with no parole? I get that a hate crime trial might make the Arbery family feel better but practically it won't actually do anything, would it? They can't get more life in prison. Unless it's one of those things where life means 25 years minimum and not actually life.

I don't know. It would end up being a symbolic trial and i'm not a fan of that. But the dudes are total pieces of shit.

Gregory and Travis McMichaels have signed plea deals with the DOJ to allow the men - serving Life Without the Possibility of Parole in GA state prison - to transfer to preferred Federal Custody. This back room deal represents a betrayal to the Arbery family who is devastated.

Literally every news story I can find on this deal specifies the details of the plea have not been released. That quote is from Lee Merritt who has no involvement at all with Arbery's murderers so idk how he would know the details of a plea he had no involvement in before the details are made public.

The only way they are ever getting out is through appeal/pardon or outright escaping. A plea deal for Federal hate crime charges cuts off the appeal route because they're still pleading to something with Federal prison time. A trial could end up being not guilty and if they win the state appeal, they walk.

The benefit to them here is that both spend 30 years in Federal prison, which is much nicer than state prison and they wouldn't have to be in protective custody or solitary like in state. The father dies in Federal and the son is moved to state after 30 years.

By going to trial now, they're not only wasting millions for nothing, they've opened up the door to possibly get out. Stupid move.

While what you're saying is true, it's not likely to happen. That's what they weigh when deciding to accept or not accept deals like this. The case against them is very strong so there is no need to make a deal on the off chance they get found not guilty.

Prosecutions don't really offer pleas because they think their chances are good or bad. They offer it to save money and get it over with and to move on to the next case. Almost everybody gets offered a plea at first.

The defendants would be motivated by chances way more. Meaning if they took it, they expect to lose in the actual trial.

This is a pretty bold deal to begin with. They're basically pleading guilty to the actual charges from what I've gathered, instead of something much lower. The state to Federal prison change being the only condition. So it's a guaranteed conviction.

Compared to the costs and chances of getting off. I mean, it serves no purpose here to go through that when you basically got them twice over.
