The girls already had reported the assault to the police, so when they came they determined "it wasn't technically assault" because the girl didn't get hurt with the smoothie thrown at her. That's not the definition of assault, just because you dodge a punch doesn't mean someone did not assault you. But yes cops in America ARE That dumb and they DO not prosecute white men like they would black or brown men. It wasn't until the it went viral on social media did charges get pressed.
