You admit that there are multiple braking systems yet think its solely the drivers fault they all failed simultaneously.
That testimony doesn't say anything about the Engine Compression brake or a transmission ret*rder (stupid fucking babyfaqs censor). Also, there are signs on grades like that telling truckers to use low gear to keep from gaining a ton of speed.
And again, as the driver, it was his job to check that the rig was safe to drive before he set out. He didn't. 50 miles before the crash he stopped because his truck's brakes were smoking. Then continued after not adjusting the trailer brakes, or giving the truck brakes ample time to cool off so they'd work. And then he avoided a runaway truck ramp and plowed into stopped rush hour traffic at 85mph, causing an explosion, injuries, and four people to die. If he'd drove up the runaway truck ramp like he should have done, none of this would be happening. So yeah, this is 100% his fault.

MrDrMan posted...
Im not saying the driver is at no fault but to claim the brakes failed entirely due to his own negligence is flat out bullshit.
They have spots where drivers are required to check their brakes are properly adjusted and to adjust them if not. Obviously he decided that "mandatory brake check" sign didn't apply to him. So yeah, the crash is a result of his negligence.

That only reinforces my point that circumstances out of his control caused the crash. Its not just blind negligence like everyone here is trying to say.
Um, no it doesn't reinforce your point. Especially not when he stopped before he lost brakes to call his boss and say he was losing brakes. Then kept going. He was negligent and 100% guilty of every charge he was convicted of.

His boss was the one that told him to keep going! He expressed concern and the people above him didnt care. That is on them.

Any good employer would have told him to stop. They didnt.

We can agree to disagree at this point because you refuse to admit his employer is also responsible and its just ridiculous at this point.

And as the driver it was his responsibility to say "no, the truck is unsafe." He didn't. And again, even after that, he ignored a runaway truck ramp which would have safely brought the truck to a stop, and instead used slow traffic as a substitute for brakes.

Your refusal to understand that when you're in command of a large vehicle with potential to cause serious damage, you assume responsibility for what it does, is ridiculous. You know nothing about being a truck driver. But yes, I'm glad you're willing to admit you're wrong about this, even if you won't flat out say it.

If a plane crashes due to mechanical failure is it on the pilot or the airline?

Its both. Dont put words in my mouth. I just dont care to hear anymore of your nonsense.

Your dad being a trucker doesnt make you an expert. The fact I even have to explain that is embarrassing.

Tell him to stop driving? You act like its rocket science. Its pretty simple.

Stop driving the truck. would have saved those peoples lives.

Clearly I have more understanding of what a trucker is supposed to do than you. And the jury clearly agrees that he was negligent. You can argue about the sentence length, but he deserves prison time, period. And thankfully he'll get it.

Irrelevant when you lack the common sense to realize an employee should never have to choose between his job and a life sentence.

There's a short fall of truckers. He could easily have gotten a new job. And I love how you keep ignoring that this moron failed to use a runaway truck ramp. Which are for, you know, trucks that can't stop because the driver cooked the brakes instead of using other methods of slowing down.

If you read his testimony he says he didnt see them until it was too late. He believed a turn at that speed would flip the vehicle.

Maybe Im asking too much but I just think as society we should be more empathetic. Its easy to say you should have done this, done that while sitting at home. Its not so easy while driving a multi ton vehicle at highway speeds with faulty brakes.

The guy made some poor choices but circumstances played a part. That needs to be taken into account and I really dont think it is.

That's nice, Runaway Truck ramps often precede turns to allow the truck to go straight to them, without turning. He turned to avoid it. And yeah, you usually don't see traffic around a turn until you make the turn.

His employer told him how to do a brake check. He did it incorrectly. As such, they did not have all of the info needed to tell him to stop. He essentially told them the check was fine.

lmao what the fuck is this bullshit? are people really trying to argue it's solely the fault of the driver and the company doesn't deserve any blame? get out of here with that garbage ass take

anyway it's good that he got that ridiculous sentence reduced but 10 years is still too much. when is the company he worked for going to be prosecuted for their pervasive safety violations?
