Congress likes to delegate power to the executive branch when the create laws to establish some agency. The President having OSHA or whatever set some rules is entirely legal. So long as the rule is about something the agency was authorized to regulate by Congress.

OSHAs emergency temporary standard said covered employers must develop, implement and enforce a mandatory COVID-19 vaccination policy unless they adopt a policy requiring employees to choose to either be vaccinated or undergo regular COVID-19 testing and wear a face covering at work.

Employers had 30 days to implement a vaccination and/or 60 days to implement a mask and test plan from November 5, 2021.
This does not affect a separate directive from the Centers for Medicare & Medicaid Services requiring employees of medical facilities to be vaccinated by December 6, 2021.

OSHA is complying with the ruling.

I don't know why people are suggesting OSHA is suspending this because of some interest. It's their standard that they made.

That they are fully in the right to make, but apparently there's a battle to be had.

If people go along with it, they can make endless vaccines or other medicine, mandate them, and barely test any of it for safety. To that reality, I say HELL NO.

Many of the petitioners are covered private employers within the geographical boundaries of this circuit. Their standing to sue is obvious the Mandate imposes a financial burden upon them by deputizing their participation in OSHAs regulatory scheme, exposes them to severe financial risk if they refuse or fail to comply, and threatens to decimate their workforces (and business prospects) by forcing unwilling employees to take their shots, take their tests, or hit the road.

lol biggest crock I've ever seen. If you can't afford to keep your employees alive then you shouldn't be in business. Same for companies who can't possibly pay a living wage.

These "burdens" placed on them are such that any talented consultant (points to self) can draw up the necessary plans and establish the needed connections for affordable testing within a week.

As the name suggests, emergency temporary standards are an unusual response to exceptional circumstances. Intl Chem. Workers, 830 F.2d at 371 (quoting Pub. Citizen Health Rsch. Grp. v. Auchter, 702 F.2d 1150, 1155 (D.C. Cir. 1983)). Thus, courts have uniformly observed that OSHAs authority to establish emergency temporary standards under 655(c) is an extraordinary power that is to be delicately exercised in only certain limited situations. Id. at 370 (quoting Pub. Citizen, 702 F.2d at 1155).

The "exceptional circumstances" in this case would be a political party committed to the destruction of the country in whatever means it decides fit.

The rest of it includes such gems as "why 100 and not 99 HUH?" and "you can't do this until you individually analyze EVERY single workplace for risk because it's ONLY FAIR".

The only thing that convinces me that this wasn't written by you is that it's 22 pages long and includes citations.
