This is so critically stupid. This is literally a lawsuit that they do not want to win. Because if they win then suddenly we're gonna see a lot of state constitutional abortion rights.

Okay, so I want to provide some context to this. Ken Paxton is being petitioned to by James White, member of the Texas State Legislature. He alone published this, pushing for a response from Paxton, who has not acknowledged this since it was posted five days ago.

Why? Well, it has nothing to do with him actually attempting to change state policy; He knows that's a losing fight because Paxton himself has been at the end of numerous failed lawsuits. The reason is pretty clearly because White is retiring from the TX legislature to run for a statewide agricultural office, and is using this to head attention towards his name.

To be clear - I'm not defending White or even Paxton, just noting that this is basically a trolling attempt to get public attention and is being misreported as either Paxton himself or the collective TX legislature when it's not. It's a deeply cynical move that (unfortunately) worked and got a lot of attention on the guy, who notably has his name plastered all over the letter.

I also should note that all of Texas' counties officiate gay marriage licenses; the sole county of 250+ in the state denied licenses until 2020. As of now, the issue is not legally contested, owing to the SC's ruling and numerous failed lawsuits that died as soon as they reached the Texas SC. Basically: No, Gay Marriage isn't going to the SC again, at least not over this.

This is all true, but I think you may be underestimating how much SCOTUS inaction on Roe is a bellwether for this shit to be tried across the country. Legal precedent was overturned in Texas and allowed to fly; there's no reason that can't and won't be applied in other situations.
