Got hit on the freeway. A third car caught it on dash cam. Provided video to police.

Meanwhile, I took car to auto shop who quoted repair cost. Insurance adjuster says car is totaled which means the repairs will cost more than the vehicle's value. They gave two options. Insurance will buy the car for ~$7000 or they give $5000 to try to make our own repairs.

Back to the police, they found the guy on video. But apparently, his insurance doesn't help me one bit. Still have to choose between the two options. Is this correct? I feel like the other driver should pay for it all. Shouldn't the other driver be responsible and buy us new car or pay for the repair regardless of the car's value?

Why does it matter who actually pays for it if you get reimbursed? That's the reason you have insurance, so it gets covered.

Either way, I'd take the 7,000 if it were me.

Selling the car for $7000 still means we have to look for a new car to buy. And it may end up being a worse or more expensive car. We've been down a vehicle for almost a month now already.

I still don't understand what you are upset about. Did your insurance say they were going to increase your rates because of this?

Upset isn't the word I would used. I'm confused.

Forgot to mention taking the $5000 to repair will still result in a salvage title meaning we lose money if we sell the car down the road.

Taking the $7000 to sell the car means we're hassled with looking for a new car. Possibly a worse car which means we lose out, or a more expensive car which we are not wanting to pay for.

I'm thinking the driver at fault should pay for the full repair even if it's higher than the value of our vehicle.
