Batman definitely can't beat him in a straight up slug fest, but using the environment and some gadgetry to his advantage, I can see Bruce coming out ahead over Peter. That said, in a fight "to the death" neither one of them would win because neither one would deal the killing blow intentionally. Spider-Man moves absurdly quick, has precognition for any incoming danger, and the strength to rip Batman in half. Not to mention how agile he is, and his webbing/gadgets.
