Do you think this drunk deserved the 5.5 million?


Daniel Rawls, who has a history with arrests for PUBLIC INTOXICATION has won a hefty 5.5 million lawsuit at a RESTAURANT claiming they OVERSERVED him alcohol that got him into a bloody fight with a man causing him to get severely injured!!

He won the suit against La Fogata Mexican Grill and Bar claiming he sustained serious and debilitating head injury during a fight with a drunk man after boozing it up at the bar before the violent brawl with Robert Henrickson following an argument at the parking lot

He was arrested in February 2019 and then this past May for being drunk in public but claimed the bartender, hired by ownder Lourdes Galindo had not properly trained staff on how to recognize when a customer "had enough" of alcohol and might cause trouble if drunk

Galindo never responded to the lawsuit and gave Rawls the default judgement.

However a court did not rule on whether Rawls claims were true and La Fogata did not return dialymails request for comment as she has 30 days to appeal

Rawls has had a history of drunk arrests and a hefty criminal record to back it up

So, as a teetotaler observer to this fucking stupid country's atrocious alcohol addiction from the side lines, I try to keep track of all the conflicting, hypocritical, and stupid standards regarding alcohol consumption:

  • Alcohol is legal but weed is not, despite alcohol being vastly more harmful, especially to other people.
  • If you act like a complete ass hole while drunk, being drunk is used as an excuse for your behavior.
  • Since apparently this dude not only successfully blamed the bar for his actions, but didn't go to jail for assault and battery, alcohol consumption also absolves you of guilt for committing some felonies.
  • If you drink and drive you should've known better, but the courts will also give you a slap on the wrist for what's basically attempted manslaughter, so... kind of a mixed message.
  • If you're a woman and get drunk and a man sleeps with you, then you are a helpless victim who was sexually assaulted.
  • If you're a man and get drunk and a woman sleeps with you, then it's your own dumb fault.
  • If both parties are drunk and sleep together, it's the guy's fault.
It's just so fascinating (disgusting) that depending on the crime you commit while drunk, who you commit it against, and whether or not it's a topic that the court system has decided to not give a shit about, you're either 100% responsible for your own choice to get drunk and are a monster OR you're an innocent victim of the demon rum and it'd be cruel to penalize you for what you did while under its influence.

I feel like being drunk and commiting a crime should make it worse. I say that as a alcoholic. Sex stuff outside clear rape though I feel is a different story. Thought its messy. But like unless the guy out right raped the girl or intentionally persuaded a girl to get drunk for the reasons of making her easy. I feel its shouldnt be classified rape. Basically if you on your own will got drunk I feel you are still 100% accountable for your actions because you CHOSE to get drunk.

There's been at least two guys I slept with I likely wouldnt have had I not been drunk at the time but in no way did I feel raped. Endangered maybe on one case cause I went home with the guy and once he had to take me back home I learned his sober driving was worse than most drunk peoples.

There are rules about not serving wasted customers, it was ignored and the bar had to pay for it, also how did they not know this guy, he has a record of crimes tied to his alcoholism.

They can probably appeal it, and they'll likely have to since there's no way the restaurant has that much money in the first place.

It doesn't specify the outcome of that case, but he's already had a history of doing time for alcohol-related stunts.

Keep in mind that there's significance time between the arrest and when something goes to trial, particularly now.
