Committing a crime with an element of bias is a hate crime. That isn't limited to a bias based on race or sexual orientation.

I agree it's a bit heavy handed for something so petty. But maybe don't commit crimes and you won't have to worry about it.

Enjoy all of this while you can. When cops go too far or they attack the wrong person and they're declared an enemy of the people, it will be too late to take this back. Right now cops are counting on the fact that even though they are usually outnumbered 3:1 in all scenarios, that no civilian would dare interfere. What happens when that changes?

Certain states include the homeless & police under direct protection from hate crimes, among other groups (such as shaming someone for attending one school over another)

And of course this happened in the most heavy handed state (Utah)

including officers in that blanket is bullshit and dilutes the point of such legislation

This is the crux right here. The penalty for vandalizing a $5 yard sign is rightly probably pretty low. Hate crime charges are probably pretty steep, and rightly so.

This cop is trying to send some kind of "message" by overcharging this young girl over a yard sign.

If the sign is someone elses property, its the victims choice in whether charges are brought on that count. However, I take serious issue with the officer noting the intimidating smirk in the report or charging documents.

Police are already protected classes in cases where it actually matters, like when theyre physically assaulted. They dont need to be, nor should they be, protected under hate crime statutes.

Depending on the location and what exactly was said, it might not even have been a legal arrest.

Like in many states she could've said "I don't answer questions" and the cop can't reasonably assume she was committing a crime by her actions and had no legal reason to arrest her. That would've probably been ignored in some sort of "deal" offered to her though. I hope there's a proper recording of the encounter.

That was my guess, actually. They said her stories were inconsistent, which led to my assumption.

And it doesnt matter if its a hate crime (which I dont think it is). If she destroyed stolen property, its still a crime.

But it says right in the article its being treated as a hate crime. She wasnt arrested for destroying stolen property. That wouldnt come with years in jail. Now she just has to fight this bull shit all because a cop got ass hurt. He appprently left an actual traffic stop to confront her about this.
