In theory, they get a trial. Given what we know so far, though, it's possible that trial is just for show given that the sentence is always being pruned. There is a theory going around that the TVA is staffed by brainwashed variants though.
In practice, the Minutemen probably don't always bother. The classic twist is that even though there are variants, technically speaking ~ it was meant to all meant to happen. Then, theres the concept that some things in time cannot be changed.... and some things can. For example, any author is familiar with the concept of selecting an outline for their story skeleton (perhaps something Biblical or Shakespearean or the good old Slasher Movie structure) and then filling in the gaps with basically whatever they want.
