Attorneys have told Newsweek that the "blame Trump" defense isn't a strong one because in a trial, defendants will be held accountable for their own actions. Joseph Hurley, Antonio's lawyer, acknowledged to the Associated Press that misinformation is also "not a defense."

"But it will be brought up to say: This is why he was here. The reason he was there is because he was a dumb*** and believed what he heard on Fox News," Hurley said.

Antonio allegedly wore a tactical bulletproof vest adorned with a "Three Percenters" patch, a symbol of the militia group, according to court documents. He was arrested in Delaware on April 20 after officers received a tip that he was one of the people law enforcement was looking for in connection with the riot.

"You want war? We got war. 1776 all over again," Antonio said in a video from the riot.

I really hope this kind of sentiment goes into public record during the trials.

Testimony isn't enough to prove something like that in a court of law, especially because anybody could blame any random person or thing for a crime they committed. They'd need tangible, direct evidence. Like someone on FOX encouraging it on video for example

If enough people say it was Fox and a lot have, that should be more than enough. Specially with the slant Fox is pushing.

The Dominion lawsuit resoundingly demonstrated that the one and only way to stop the right-wing disinformation juggernaut is to hit them hard in the only place they'll feel it: their wallets. Yes, that's exactly what they're doing, and yes, it can be true. They were influenced. They were made to believe something was true and used that information to perform an action. The action is still their fault, but the reason they performed the action can still be held liable. They won't get off with this Fox News defense, but if enough of them use it (which they are) it could open up a can of worms for Fox.
