I don't have a source. I just watched a report on the incident on New York 1 news. Apparently he put his knee on a teenage suspect's neck a few years ago until the kid passed out.

The new defense can be that putting his knee on someone's neck wasn't fatal in the past, so it must have been drugs or a heart condition.
