But it was because police took them into questioning for a crime the police thought they were involved in. Police took their phone why they were at the station, so they weren't able to notify work what happened.

That's outside the person's control, and firing them for it would be an absolute dick move (and at least where I live, probably illegal). That is assuming the person was not actually involved in the crime (beyond perhaps being a witness).
