from the video we know that he knew Floyd wasnt breathing, and minutes later he learned that Floyd didnt have a pulse. He still kept his weight on Floyd for several minutes beyond that.

Also people seem to get hung up on the "premeditated" part of murder. Premeditated doesn't mean you meticulously planned out every detail of how you're going to kill someone. It can be a spur of the moment deal. You never intended to kill someone, but then something happens and you decide to take an action that you know has a possibility of killing someone, and it does. That can be tried and found guilty of premeditated murder.

There's a fair amount of grey area. In particular, given that the altercation had died down well before Chauvin stopped kneeling, it could very easily be argued that he made the decision to kill him rationally and deliberately (first-degree murder), rather than as an escalation of the fight (second-degree murder). Proving that, however, is another matter entirely, and failing to do so could have allowed him to go free, so second-degree was a much safer charge.
