The one that was hurt decides to sue the one that caused the injury. So what exactly is entitled in an estate? Let's say they live with their family member but do not own anything. So their name isnt on the house or car. Unless the family members have specifically agreed to be guarantors, nope, it can't touch them. Not even partners (though jointly-owned assets can be touched). Except of course to the extent of "if they sue and win, there's less left for everyone else to inherit", of course. (Disclaimer: Not a lawyer.
