tl;dr we don't know. Multiple legal professionals believe it can be interpreted either way and it has never been tested in court.

Nope. He was impeached between December 18 2019 and February 5 2020 and did not issue pardons during that time.

(Last/first around impeachment was November 15 2019 and Feb 18 2020)

I think it would make more sense to interpret it as saying that the president can pardon anyone, except those who have been impeached. The argument for this would be that it would be unreasonable for the president to be able to overturn both the house and the senate and an analogy would be the presidential veto power being able to be trumped (no pun intended) by the house and senate.

There's an argument to be made that if the president can pardon people while being impeached himself then impeachment is a useless tool for removing the president since he can order people to destroy the evidence against him and then pardon them.

Or more succinctly should a potential criminal be allowed to determine what other criminals go free?

here's how this will go down.

  1. trump will ignore this, and write a bunch of pardons.
  2. they will be contested right up to the supreme court.
  3. the supreme court will rule in favor of trump, declaring that impeachment truly is a worthless mechanism and the executive branch has divine right to declare themselves above the law.
