Damages should include time, effort, physical injury, lost wages, emotional turmoil, and probably more.

I'd only sue for the exact amount, like on Judge Judy or something... like if someone broke a pencil I'd sue for 17 cents or whatever (not sure why I used an object I don't know the price off as an example but whatev)

Hopefully I would be emotionally stable enough to sue for only the cost to fix the situation and any potential loss of wages. As for tacking on additional amount to cover trauma and potential future medical cost, I honestly do not know how one puts a price tag on that.

Speaking of not getting extra, I certainly hope I do not get into a situation where I need to discuss the amount/service to fix something. If I am not willing to pay X amount to fix something and would rather go somewhere cheaper, I cannot expect the person covering the damage to be willing to pay the same amount. But if I am willing to pay X amount but the person wants to go somewhere cheaper.....I just hope I do not get into such situation.

I should have sued for more. Got my spine blew out. A teenage plowed into me texting and driving. Had to have surgery, pt, and 6 months loss wages and chronic pain. Could have sued her father because it was a work truck but didn't

He's asking about a settlement, not actual damages. You can settle for as much or as little as you like, as long as the other party is willing to play ball (and settling for above the actual damages is not out of the question, depending on who you're suing, given that it will still probably be cheaper than having to pay out for damages plus the legal costs of the trial).

This is really what I was driving at with this topic. There is guaranteed to be some flexibility for intangible damages that could be added to a suit and I'm asking if you'd take advantage of the vagueness for a possible payday.

People should get only a bit above what they need but they also kinda have to ask for outrageous amounts. If they didn't, the 'a bit above what they need' would be lowered to an 'ain't gonna do shit' amount right out the gate.

I would settle for the amount of the damages and cost of anything related to the subject matter of the lawsuit including legal fees. If It was emotional or physically scarring with long lasted effects, I would add more that was reasonable of the effect of my future life. Such as, if I couldn't work any longer, it would be the total projected loss wages between the time of the event, till my retirement age.
