Is it technically child porn? Yes. 100%. By the law, downloading or viewing this video is illegal. Could also help to flame the fires of creation and distribution of child porn in general.

I haven't seen the video, but from context I'm assuming that the video wasn't originally taken for sale and was a home movie of some kind where the parents took it because they thought she was being funny or something. At the same time, it wasn't being sold for explicitly pornographic reasons (well, the "joke" in the sale was that people thought they were buying a video of the adult YTuber nude).

Likewise, not all nude photography and artwork of children is considered pornographic (otherwise entire museums would be arrested). So the standard for child pornography isn't just that it's a nude photo of a child being sold. However, I'm not sure if that's specifically a defense pertaining to art or a general exemption regarding child pornography. Regardless, it's one of those things where a person *really* doesn't want to test how the law works by doing what she did. And even if she doesn't get in any legal trouble, I imagine YT and other sites might suspend her over the backlash.

AFAIK, Production companies are still making movies with naked kids, so yeah its not cp just because a movie has naked kids in it. Or maybe people want everyone involved in movies like Tomboy to be put in prison.
