Youtube has the right to take down whatever they want. But they're based on American laws. In your Brazilian example, them saying they've owned CP doesn't really affect anything. Youtube might not send police to their door but they're legally incapable of actually hosting CP themselves even if the country doesn't have it illegal. Youtube will be charged for it if the uploader can't be. If copyright in the US gets to the point where streaming copyrighted works like games becomes a federal crime then Youtube will be forced to not allow anyone in the world to stream them without official permission.
Although I wasn't aware the actual copyright laws haven't changed so I suppose nothing will change as of yet. It's not a good sign though.
Actually if somebody claimed they had CP and they lived in the US, they'd have that video reported to hell, taken down, and an investigation most likely done on that person. Youtube doesn't actively crack down other countries' vids, and the CP thing was just one example and one guy who actually did end up getting his channel taken down for a completely different reason. Snuff shit exists on Youtube as well as animal abuse, and they're all foreign and in some deep recesses. Another example btw is the monetization crackdown on foreign entities using English cuss words, as in it simply doesn't happen. That's partially only enforced on North American side. I've seen a ton of examples of Koreans just cussing in English and they haven't gotten age restricted or whatever, but supposedly they don't want to cuss in Korean just in case.

So it's not really American laws. You can say it started that way but it's just not. They do have rules that are regional and rules that are global. Either way, this is probably only gonna affect maybe the intensity of takedowns

As for the felony thing, yeah I don't expect it to ever be enforced either except people who are blatantly posting songs they don't own. Which might definitely apply to a lot of non-official sources posting a completely non-modified version of songs they don't own.

T-T poverty stream with Kiara but I'm glad Suisei got to sing Next Color Planet.

Early in my rabbit hole dive, I completely accidentally woke up at like 4 am and just happened to catch the first ever premiere of this song. Later did I learn what a big event this was for her, so happy she was able to do it. She was probably saving it for something of this scale too cuz she didn't do it for her 500k

No, it is entirely American laws. The rules they have for other regions are all just to be on good terms with those regions or else risk the site being banned there but Youtube has to abide by American laws or they as a host can be put under investigation, shut down, and charged. You think Youtube can allow child porn if they wanted to as long as the uploader was from a country where it wasn't illegal? You think full movies can be uploaded to Youtube and that they're safe from being sued as long as the uploader was from a copyright lax country?
I think you're confusing lack of reports and business policies with actual law. There are full movies on Youtube but that's because no one reported them or the trademark owners don't care. They're technically illegal though and Youtube still needs to take them down if they are noticed due to American law regardless if it's legal in the country the uploader is from. I'm not sure what you mean by "snuff shit". If you're talking about stuff like death and execution vids those aren't actually illegal in the US and they're merely against Youtube policies. If you're talking about actual murder for profit/entertainment videos I heavily doubt there's any of those even in the darkest foreign recesses because a single notice of them will quickly balloon to the public and there are entire communities including subreddits dedicated to looking for that stuff.

Monetization with cuss words also has nothing to do with law. That's just Youtube trying to get in good with different ad companies which would of course differ depending on the country.
Now I don't really know what you mean by "it's based on American laws" anymore when I've said multiple times their base was American laws, but American laws don't often apply to foreign channels. I thought foreign channels are what we're talking about. Youtube treats other regions differently, so you can't say Youtube just acts on American laws, simple as that lol.

For snuff stuff, it's all about animal cruelty, which is flat out illegal in US and not illegal in other countries. So those videos don't get taken down. That's not acting on American laws so I don't really get what you're trying to say anymore

Also last night I dreamt that my favorite duo Suisei and Matsuri sang my favorite Vocaloid composer Mitchie M's Ai Dee, woke up and thought it was ridiculous, but it supposedly actually happened. Then they did a sick trio dance with Flare. Goddamn it, I really hope they release some way to watch these things post-live

I'm saying that if something is illegal to be shown on Youtube, such as full movies, breaching of privacies, or CP, then it doesn't matter if it's legal in the region the channel is from, it's illegal in the US which means Youtube must remove it or they'll get charged. If American laws outright makes something illegal then it'll affect all of Youtube, not just American Youtubers. An extreme example: If the US deems vtubers itself illegal then Youtube will have no choice but to ban any vtuber content from the platform regardless if it's perfectly fine in any other country.

Videos of animal cruelty itself isn't illegal in the US.
Well I just looked it up, and even mentioning you own a CP on video itself is indeed illegal and grounds for being charged. So by your logic, Youtube should be charged somehow, but that's not exactly how it works. Surprisingly uploading snuff videos cannot be charged by comparison because you can literally just claim it's not real or you didn't know it was a snuff film when you recorded it. So yes, Youtube is definitely an illegal presence if you think they should be charged for hosting something illegal in the US but resides elsewhere.

There were cases where US was actually able to charge a person outside of the US using US copyright laws, and one happened in 2012 where the owner of Megaupload was able to be charged, but there were a ton of caveat. There were already international agreements in place, and the owner of Megaupload heavily profited off ads based in US, and that was actually the main grounds for being able to charge somebody overseas, as he was profiting off of US entities while committing illegal activities in the US.

So it's not nearly as simple as you make it. Youtube probably can't touch a foreign non-monetized US-illegal videos uploaded onto their website

I'm not sure how you're missing the point this badly. The foreign defendant is completely irrelevant. Obviously the uploader themselves can't be charged if it's not illegal in their country. YOUTUBE is the one that'll be charged. Youtube would be the one to take the responsibility for having the illegal videos and could potentially be shut down if the videos are bad enough. You think megaupload didn't have plenty of uploaders from foreign countries where it wasn't illegal? Megaupload wasn't even based in the US and still got hit by US laws due to Hong Kong willing to work with the US. Youtube, being situated in the US must apply by US laws, including channels from foreign countries, or they will get into legal trouble and potentially shut down.
Like I'm not even sure what you're trying to argue. Are you seriously saying Youtube can just be a full on pirate site and be free of repercussions as long as the people uploading the pirate content are Russian channels or whatever?

Also, simply claiming you have CP isn't a crime. Where are you getting that? If you're drunk or just spouting gibberish and rant about having CP, that itself isn't illegal. You could play it off as a joke too. Simply claiming things isn't illegal in the US. It could be probable cause for an investigation but not an actual crime in itself.
Actually just claiming you have CP on camera is reason to be investigated pretty seriously lol, you can easily look this up. Claims on camera have serious legal ramifications and is admissible as hard evidence lmao. You think all CP charges are based off of some next level planting and baiting? Even intent to buy can be a crime. I don't get why you think that's legal.

Honestly, I'm kinda done with this convo, but let me just say, you missed the point on the Megaupload thing. US had no grounds to charge internationally, just on the Copyright law. They charged him via profiting off it, and the owner was willfully allowing it, which shows Youtube can only take action if somebody is profiting off these US illegal videos. Also it has nothing to do with Hong Kong because the owner was actually apprehended in New Zealand. The only thing that mattered was that the owner was outside of US, and the country was willing to apprehend the person to be charged in the US. Youtube does house illegal foreign stuff within the context of US, but they can't be charged for it because similar to this case, if the other person doesn't profit off infringing copyright and the country they reside in don't allow for it, then US doesn't actually have a ground to charge that person, so that video is no longer illegal. Youtube does take action on heavily monetized videos depicting illegal actions both in US and out, but they actually leave a sizable amount of videos with smaller views and minor channels alone due to a lack of monetization.

This matters because it changes the way Youtube deals with these types of videos and on-camera claims. I don't really know the sources in which you're making claims off of but I've stated precedence in court rulings and actual videos on Youtube that I'd rather not link here that would be illegal in the US. Also, I'll end with this. Western companies often have extremely loose streaming rules on their games and Japanese companies don't. There's an underlying reason for it. If Japanese companies wanted to block streaming, if they were US entities, the streamer can easily argue Fair Use as long as their content was transformative enough, but against Japanese companies, they actually have no grounds to contest and Youtube can't do anything about it. Even the movie industry mostly gave up on reviews that show brief clips or stills because the US law throws a bone to content creators. That's mostly due to an American Freedom of Speech push that doesn't exist to the US extent outside of US.

People realized Gura was Senzawa fairly early. It's one of the big reasons why she did so well so quick. She had a massive sub bump in the beginning and the Youtube algorithm did the rest. Kiara was also an aspiring idol b4 her Holo self. She does have a channel but it hasn't been named here so I won't mention her prev name, but she is definitely an Aust(rail)rian. Not exactly a big name like Senzawa tho

One of the big reasons for the avatars, especially in Japan, is security. After all stuff like Aloe can happen if the wrong people get ahold of too much real info. There was also an (non-vtubers) incident I remember hearing about years ago. Wish I could remember names, but it was some shitposter got targeted in real life after two forums merged. Yeah I actually know the case you're talking about but wouldn't remember the name since I saw a docu about it some time later. I'm pretty sure a google search of Japanese lawyer gets memed for awkwardly trying to stop the harassment would return the result because that lawyer got hit harder than the guy he was defending who was legit doing terrible things.

Sadly doesn't really stop from at least half the Holo girls from getting their identities revealed. Thankfully their place of residence is a bit more of a well-guarded secret, though I haven't looked at the underbellies of the Japanese underground forums
