I'm not clear on how the appeal is defining "less oversight" in relation to a "two tiered system"?

The lawsuit claims Pennsylvania officials violated the U.S. Constitution by creating an illegal two-tiered voting system where voting in-person was subject to more oversight than voting by mail.

can't wait to see the evidence for this!

and here it is!

If anything that's the exact opposite, the mail in ballots were subjected to more oversight.

They never had, nor will they ever have a real argument. And this distinct lack of competence is really all the evidence you need to know Republicans by and large are not actually trying to help Trump steal the election like he thought they would. They're just paying him lip service to placate his cult until January.
Then they'll have four years (since I doubt they'll put too much effort into trying to "save" 2022) to reprogram their electorate to pretend they were never subservient to Trump. Whether or not it works remains to be seen, but cultists do not typically stop drinking the koolaid just because "the man" tells them it's literally poison.

Yeah didnt they literally try to stop the count so they could force their own people in to "observe" the count?

Lack of oversight over the popular vote can't be unconstitutional, because a presidential popular vote isn't in the constitution.

No I'm asking what is the "decreased oversight" of mail in ballots that makes them "a second tier" (since that's what Trump is arguing)

There were already Republicans and Democrats who had followed the proper legal process to watch the process and they were in the room. Just because Trump thinks they should just be able to barge in and be part of the process doesn't mean they can just go in and do it.

his team was in the room where ballots were counted, as admitted by his own lawyers. He wanted them to be closer then they were.

When I showed up to go vote the "usual" way, I had to show an ID, and two officials initialed my line in the registered voters list and the ballot itself.
A mail-in ballot doesn't really have that, maybe? Only a few states insist the ballot is notarized.

PA only requires an ID for first time voters. If you vote in person, you sign when you you go to vote. If you vote by mail you sign the envelope and put your ballot in a secrecy envelope, that you don't do if you vote in person. What you do in not PA has no bearing on PA.

So the strategy should be finding something in PA's law, not trying to leverage a constitutional issue that doesn't exist.

the strategy should be conceding, but trump need's more donations to settle up his debts.

they're shotgunning it in hopes that it gets to to the Supreme court from one of these. it would have to be quite a coordinated effort to lie that hard, but sure, it could happen.

And to my previous point, they aren't thorough at all and don't have evidence, so it's going to be quite a bit more of a reach than Bush v. Gore.
