He was set to turn himself in TODAY after being indicted by a grand jury for fatally shooting 22 y/o James Scurlock on May 30 He was also facing charges of first degree assault, threats and using a weapon while committing a felony DA Don Kleine initially declined to file charges saying he reviewed witness statements and video believed he acted in "self-defense" But he was slamed for OVERLOOKING Gardner's RACIST history and then he asked a grand jury to review it when heavily criticized Special Prosecutor Frederick Franklin said the jury reviewed additional evidence that Klein didn't show including text on his phone and facebook with his interactions with bystanders before coming into contact with Spurlock He didnt say what of the new evidence that was new to show that changed their minds but it undermines the self-defense theory as it was "very significant" evidence of it being an intentional killing by Gardner He was also charged with attempted assault, making terroristic threats and using a gun to commit a felony It happened outside his bar as protests and civil unrest unfolded following the death of George Floyd Gardner shot Scurlock outside his bar as he sought to "ward off" any theft or property damage as surveillance shows video that showed him and his father and protesters exchanging words before he flashed a gun and backed away. He was pushed before he fired 2 shots sending people scrambling as Spurlock jumped on him after and Gardner shot him Witnesses said Gardner was antagonizing protesters and taunted them by yelling "n-word lover" Franklin said after the announcement of the suicide however that Garnder was still a presumed innocent man Gardner has an extensive rap sheet himself after his racist views were exposed that stretched to the 1990s including multiple weapons charges and several counts of assault and battery He identified himself as a "Libertarian Trump Supporter" and was furiously against transgender women The reasoning for his suicide is unknown as there was no note left behind.
