It used to be 11 at one point and they actually shrunk it. At the start of the country it was just 5. You can basically just change it any time with a legislative act.

As for "why hasn't it been abused" FDR threatened to do it because The republicans kept blocking the new deal so they backed off, and then he got 4 terms and got to pack SCOTUS anyway.

The obvious flaw here is that Democrats making it eleven seats means the Republicans will make it thirteen, then the democrats will make it fifteen, then the republicans will make it seventeen, and so on and so on, until we have 10001 justices for some reason.
Then, we'll have 10003 once the other party gets power again.

FDR threatened it because the court found the New Deal unconstitutional and he wanted to pack it with loyalists to force it through. Dems literally introduced legislation to do it. That's the thing Republicans blocked.
