UPDATE: A protest demanding justice for George Floyd in Chattanooga took a scary turn Wednesday night when demonstrators spotted a man on a nearby rooftop holding an assault rifle.

Sandra Bryant told Channel 3 she was sitting in front of the Chattanooga Choo Choo with her family when she looked up and saw a man standing on top an apartment building with an assault weapon in hand.

My first thought was I gotta get them safe, Bryant said.

A Facebook live video she recorded of the incident shows the moments she realized her family may be in grave danger.

The kids were tired so we sat down and Im like, hey you need to get the baby, get the baby and (my wifes) like no, theyre fine and Im like no, you really need to get him and its like no one knows what Im trying to say but theres a man on the building carrying a gun, she explained.

That man, later identified by police as 35-year-old Kevin Leko, was apparently carrying an AK-47 and had several other weapons with him inside a bag along with magazines full of ammunition.

Police found a broken down PA-224 with a loaded magazine in the lower, a loaded AK-47, a loaded 9mm handgun, a loaded Glock 9mm handgun, a loaded River Super Red Hawk revolver, and loaded magazines for each weapon except the revolver.

They also found beer cans and other miscellaneous items according to an arrest report.

We couldve been dead, Bryant said.

While neighbors who spoke to police said they didnt see Leko point the weapon at anyone, Bryant says she was frightened for familys safety.

It couldve been anybody, we dont know the guy, she and her wife told Channel 3.

Minutes after Bryant began recording, police arrived in the scene to find Leko who appeared to be intoxicated.

An arrest report says Leko complied with verbal commands from police to put his weapon and bag down.

When they asked why he was on the roof with the weapon, he said watching protests and riots nationwide on the news caused him to have anxiety.

He told investigators he wanted to be ready to defend himself.

Leko also admitted to police he had been drinking.

They want a peaceful protest from us but you cant march peacefully if you got someone pointing guns in your face, Bryant said.

She told Channel 3 she was just glad police arrived when they did or there may have been a different outcome.

Leko was charged with Possession of a Fire Arm Under The Influence but has since been released on bail.

Hes due back in court on June 18th.

Why didn't the police open fire here? He wasn't fleeing. He was presiding over a bunch of people with multiple guns ready to fire. I don't think you can be more of a threat than that.

Rayshard Brooks wasn't a lethal threat. This man was.

Brooks fired the taser twice, which meant it wasn't even loaded anymore. Which meant he was basically unarmed. And he was still shot in the back.

I'm just looking for consistency here. These guys argued they would have pulled the trigger because he was a lethal threat. I don't know what's more of a threat than a guy holding an AK looking on over a bunch of protesters.

Oh, and they defended the police's handling of Dylann Roof too, who had just committed multiple murders and had guns on him when arrested and taken to Burger King.

I saw the full body cam/security footage. These cops showed restraint all the way up till the very end. Look at the Wendy's security footage. The second Brooks began to turn around with the hand that held the taser outstretched, the cop was already going for the gun on his belt. The second Brooks turned to fire, he had already sealed his fate because that motion alone will force a cop to commit to shooting.

Other guy was on the roof in an intimidating way. I agree that the woman who called in should have done it. I also think that he should be charged with intoxicated possession of a fire-arm. But it's not like police were magically there the second he was spotted. He stayed up on the roof, simply observed for a while peacefully and when the cops came, he was taken in without incident.

You can argue lethal or non-lethal. I'm arguing aggression vs non-aggression. Brooks was aggressive and even violent with the officers who arrested him. This man wasn't.

Pointing a weapon at an officer and firing is justification for lethal force every time. Especially if you punch one of them and stole that weapon off of them. Doesn't matter who does it.

The DA has already said things that conflict with both the body cam footage and the Wendy's security footage. So forgive me if I don't take the man leading a witch-hunt at his word.

I really don't know much about the situation but I heard that he reached for the taser or successfully got it and if he did... what happens when he incompacitates the cop even for a couple seconds? Guess what im going for the gun and then its too late to think about using lethal force against someone because they flipped the tables or odds on you that quickly. And if that isn't the right interpretation I apologize and I'm not going to speak on it anymore

An autopsy found that Brooks was shot twice in the back.

In announcing the charges, Brooks revealed disturbing details about the incident. Howard claimed Rolfe knew the taser Brooks took from him was not functional, as it had already been fired twice and thus was of no use when he shot Brooks twice in the back as he was running away.

The detail appears to underscore that Rolfe was apparently aware he was in no physical danger when he fatally shot Brooks. Cameras also captured Rolfe kicking Brooks as he was on the ground struggling for his life.

Gonna lay down a super hot take here and say this was an example of good police resolving a bad situation, and should be encouraged and congratulated.

If details come out that the police involved here are ultra nationalist klansmen and they were all rubbing shoulders and having a grand ol time before bringing the dude into the station I'll retract this statement, but it seems like these are the cops we actually need right now.
