He was set to die over the 1998 murder of an elderly mobile home park owner during a robbery but was given a 4 month reprieve over the delay of executions because of COVID-19 as well as not being allowed a priest at his execution which they said was a violation of his religious rights!! The Supreme Court granted the emergency petition by lawyers after they banned chaplains and other religious advisors to death chambers as Gutierrez is Catholic On the night of the murder, he was attempting to steal more than 600,000 that Escolastica Harrison hid in her home before he killed her.
