Investigation ongoing with other three, but they're taking priority with Derek obviously.

They have the bodycam footage too which is nice. I fully expected "malfunctioning or not on camera" lol

I think he should also be charged with second degree murder. I think it's pretty easy to infer the intent to cause bodily harm when the victim and multiple bystanders are screaming, begging, pleading for you to get off the victim's neck, check on him, anything. All while the victim cries and then goes completely limp for minutes. That's beyond reckless, that's intent, even if there was no specific intent to kill him.

They probably went with 3rd degree to be completely sure he got convicted of murder and so they could say they charged him with murder. Because if he somehow walks after the trial, multiple cities will burn.

First degree murder under Minnesota state law means they'd have to prove beyond a reasonable doubt that the murder was premeditated (or committed while performing a sexual act). Even second degree would be tricky because they'd have to prove that it was committed during another felony offense by the officer, or that the Floyd had a protective order against Chauvin.

There's a precedent for reloading a gun counting as premeditation. Because it's the right amount of time to think about your actions. No chance in hell that a jury wouldn't convict him.

It just infuriates me. My nephew was charged with 20 charges for dealing drugs. Did he deserve it? Hell yes. Did the police take advantage for political gain? Absolutely. They need to prosecute to the fullest extent on their own as they do anyone else.

They were waiting for more evidence to come in like the police body camera footage as well as combing through law statutes to make sure they could be completely confident in the charges they were bringing. The way I understand it is as follows:

1st Degree: Cold Blooded murder. You have time to think about it and still kill someone. For example you find your wife is cheating on you and so you decide to murder her in the park later that week.

2nd Degree: You kill someone with intent but it's in the heat of the moment and you're hot blooded. For example you walk in on your wife in bed with another person and then shoot them dead right then and there.

3rd Degree: You kill someone but only intended to hurt them.

Apparently MN is only 1 of 3 states that distinguished 3rd degree murder from manslaughter so it's probably a bit weird.

Yeah, retaliation is a big problem. The whole situation in that aspect is like a gang, no snitching, look the other way. The culture needs to be changed.

The problem is that his defense is going to argue that he did not intend to kill Floyd and I'm not sure how his intent can be proved one way or the other.

I think the fact that he willfully kept his knee on Floyd even after he lost consciousness is enough to prove there was malicious intent

Right but was it intent to kill or to harm? Alao please bear in mind I think Chauvin is a fucking murderer but these are the arguments his defense will make and the prosecution will have to overcome.

Also keep in mind cop loving fuckwits will no doubt contribute to a go fund me for Chauvin and he will have access to very good lawyers.

And also keep in mind is how much do we actually trust the DA to put forth a full effort in this case when it could very well damage their relationship with the cops they work with and rely on.

Make no mistake I think Chauvin is a fucking monster but this is sadly far from a slam dunk case.
