Man should be charged but it cam be viewed as improper training or mistake made in the heat of the moment. and brushed off that way. Way I was trained you kneel on the back of their shoulder as you cuff them. Normal civilian would have no justifiable reason to be kneeling on a downed person at all so yes hes getting treated differently than a normal peraon would.
