Seems to me that she is a woman who was hounded and massively abused by some meth head to the point of having massive PTSD. It is not at all a stretch to assume that even at the time, she was not remembering events properly and was massively affected by the physical and emotional trauma.

What we know for sure is there is evidence of the physical abuse. Abuse that tracks towards a sexual assault, though the full scope of that is unknown via investigation. We know that she was physically assaulted and strangled.

I'm unsure if there is any evidence about this guy strangling her brother or not, but if it is a case of ongoing physical violence against her, and basically being held against her will, I think the use of a gun to stop the threat is justified.
