SOUTHAVEN, MS (WMC) - Documents show that Southaven officers went to the wrong house to serve a warrant on Monday, which resulted in the shooting death of a man who did not have any active warrants out for his arrest.

A warrant out of Tate County shows Samuel Pearman was wanted for domestic assault. But, when Southaven officers arrived on Surrey Lane to arrest Pearman, they did not show up to the correct house.

Instead, officers missed their target by 36 feet. Those 36 feet made all the difference to Ismael Lopez and his wife.

"Someone didn't take the time to analyze the address," attorney Murray Wells, who represents the family, said. "This is incredibly tragic and embarrassing to this police department that they can't read house numbers."

Wells pointed out that the house officers should have gone to, the one where Pearman was located, had a large 'P' on the door. While officials sort out what happened, the man they were looking for took to social media.

Pearson even posted on Facebook Live on Tuesday afternoon claiming he didn't do anything wrong.

"They made me out to be something I'm not," he said. "I haven't hurt her. She's the one who slapped me."

Ismael Lopez and his wife, Claudia Linares, were asleep inside their house across the street from Pearson when officers arrived.

Linares said her husband went to the door to see what was happening outside. That's when she heard gunshots and by the time she reached her husband, he was already dead.

"Bullet holes suggest they shot through the door," Wells said.

Officers said Lopez came to the door pointing a gun at them. Those officers claim to have asked Lopez multiple times to drop the gun before they started shooting.

But, neighbors said they didn't hear anything like that.

"I didn't hear yelling," neighbor Nicholas Tramel said.

Tramel's room is right next to the Lopez home. He said he never heard police tell Lopez to put his rifle down.


Wells implied that officers had reasons not to tell the truth in their account of what happened. Namely, because they could face consequences for shooting Lopez. He also said that Claudia, who was the only one on the property who could not be held responsible for shooting Lopez, did not hear any commands or instructions being given. In addition, Wells said Lopez never pointed a gun at the officers.

"There was a gun on the premises, but the man did not have the gun with him when police shot him," he said.

Wells said Claudia Lopez wants justice and for the world to know that her husband was a good man.

"When they came to my office, it wasn't money they sought. They wanted the story to come out," he said. "What they want everyone to know is who he was and what happened."

Wells described Lopez as a hardworking employee who, up until about four years ago, worked for City of Bartlett as a mechanic.


"They've been in that home for 13 years. The only time the police had ever been there was when they had been robbed," Wells said. "No criminal history whatsoever. A long-standing employee of the city of Bartlett, mechanic. Loved in the neighborhood."

He continued, "This could have happened to anyone. Her [Claudia's] sense of justice doesn't really come from a place of anger, but of confusion."

Lawyers for the family of slain auto mechanic Ismael Lopez have released hundreds of pages of investigative documents related to his 2017 fatal shooting by a police officer at his home in Southaven.

A grand jury has already declined to file charges in the case, in which officers went to the wrong house during a search for a domestic violence suspect. Federal authorities opened a civil rights case but decided not to move forward.

But with a civil lawsuit looming against the officers and the Southaven Police Department, attorneys for both sides are using information in the Mississippi Bureau of Investigation report to support their interpretation of events.

Three bullets through the front door

Lawyers for the Lopez family acknowledge a .22-caliber rifle was found near the door, but they dispute that the mechanic pointed it, saying his body was found some distance away inside the mobile home.

They maintain one Southaven officer heard another officer shoot at the family dog, prompting the first officer to open fire at the house through a closed door. Lawyer Aaron Neglia called it a "murder," while his partner Murray Wells raised the possibility of an accidental shooting by a young officer.

They point to forensic data in the MBI report that says three bullets passed through the homes front door and one hit Lopez in the back of the head, killing him.

Until this point, officials in Mississippi had refused to officially acknowledge some details about the shooting, including the officers' names. Those names and other details are finally confirmed in the MBI report, which lawyers went to court to obtain.

Officer Samuel Maze, who reportedly shot at the dog, had graduated from the police academy only about 20 months before the July 24, 2017 shooting, according to the MBI records. Officer Zachary Durden, whom investigators concluded fired the fatal shot, had graduated only about 16 months earlier, according to records.

A third officer on the scene didn't fire.

The documents add far more detail to the public understanding of the shooting, which triggered national media attention and protests.

Maze said Durden insisted on going into the home to help the man he had shot. There was blood and brain matter on the floor surrounding the suspect, Maze said. He described Lopez taking labored breaths, as though he was snoring.

Officers would end up handcuffing an unconscious Lopez as well as his wife, Claudia Linares, according to the officers' statements. Records say they called for an ambulance immediately, but it was too late.

The MBI investigators concluded the investigative report by putting the blame on Lopez.

Agreed about them being charged and the department sued. Problem is, the justice system at large doesnt seem to want that for...some reason.

Its possible it was just a (really, really dumb) mistake made by a group of imbeciles.

Mistake or not, though, there are consequences for murder/manslaughter for everyone except cops.

So our main issue is with the justice system at large, not individual police.

All cops are bad by the nature of their job.
Every cop, when they become one, agrees to enforce all laws. We have many laws on the books that are manifestly unjust, immoral, unethical, or even intentionally malicious. Which means every cop has agreed to enforce laws that are unjust, immoral, unethical, and malicious. There is no such thing as a good cop. There are cops who are good people outside of their job, but there are no good cops.

It's been ruled by the supreme court that the cops are not required to protect you. In fact, if your landlord refuses to fix your home in a timely manner, or your boss doesn't pay you, the cops won't do shit. But they will be there to evict you if you don't pay your rent or to bust up your strike if you decide to picket.

Think about Standing Rock. These were people trying to protect their water supply from an oil pipeline that is pretty much guaranteed to ruin it. If the cops job was to help or protect you they would have been on the same side of the line as the people protesting. Instead they were busy spraying people down with water in sub zero temperatures, beating them, gassing them, and shooting them with rubber bullets. For trying to protect their water from a corporation.

The police exist to enforce private property rights (IE the Standing Rock example), maintain order so that people continue to make money, and to enforce the will of politicians who are owned by corporate lobbyists.

Keep telling yourself that bootlicker. The pipeline crosses the Missouri river 20 miles from the intake valve of their original water supply. They've since (already under construction for years) built a water treatment facility 70 miles downstream from the pipeline crossing. The Missouri River typically moves at about 5 to 8 miles per hour in the upper Midwest, meaning it would take nine to 14 hours for oil to reach the tribes new intake valve. Is that enough time to close the intake valves? Probably, assuming the company knows about it and alerts everyone immediately. Is it worth risking? Not if I lived on that reservation.

Nope. The tribe was actually trying to get them to pay more to run it through tribal land, but when the oil company decided to route around tribal land because it'd be cheaper, the tribe made up all the bullshit you just said.

Keep telling yourself that bootlicker. The pipeline crosses the Missouri river 20 miles from the intake valve of their original water supply. They've since (already under construction for years) built a water treatment facility 70 miles downstream from the pipeline crossing. The Missouri River typically moves at about 5 to 8 miles per hour in the upper Midwest, meaning it would take nine to 14 hours for oil to reach the tribes new intake valve. Is that enough time to close the intake valves? Probably, assuming the company knows about it and alerts everyone immediately. Is it worth risking? Not if I lived on that reservation.

A warrant out of Tate County shows Samuel Pearman was wanted for domestic assault. But, when Southaven officers arrived on Surrey Lane to arrest Pearman, they did not show up to the correct house.

Officers said Lopez came to the door pointing a gun at them. Those officers claim to have asked Lopez multiple times to drop the gun before they started shooting.

But, neighbors said they didn't hear anything like that.

"I didn't hear yelling," neighbor Nicholas Tramel said.

Tramel's room is right next to the Lopez home. He said he never heard police tell Lopez to put his rifle down.


Wells implied that officers had reasons not to tell the truth in their account of what happened. Namely, because they could face consequences for shooting Lopez. He also said that Claudia, who was the only one on the property who could not be held responsible for shooting Lopez, did not hear any commands or instructions being given. In addition, Wells said Lopez never pointed a gun at the officers.

"There was a gun on the premises, but the man did not have the gun with him when police shot him," he said.

Wells said Claudia Lopez wants justice and for the world to know that her husband was a good man.

"When they came to my office, it wasn't money they sought. They wanted the story to come out," he said. "What they want everyone to know is who he was and what happened."

Wells described Lopez as a hardworking employee who, up until about four years ago, worked for City of Bartlett as a mechanic.


"They've been in that home for 13 years. The only time the police had ever been there was when they had been robbed," Wells said. "No criminal history whatsoever. A long-standing employee of the city of Bartlett, mechanic. Loved in the neighborhood."

He continued, "This could have happened to anyone. Her [Claudia's] sense of justice doesn't really come from a place of anger, but of confusion."
