Basically, because people are dishonest and children are often used as smokescreens for smuggling/trafficking, others have to suffer. I'd rather an innocent 9 year old be detained for 32 hours and then released as opposed to letting her and the 14 year old through unhindered with drugs, guns, or if the 9 year old was actually a trafficking victim.

Blame the cartels and human smugglers for making children a valid target for this kind of suspicion.

With probable cause, sure. Just owning a gun isn't probable cause.

However, crossing the border is probable cause to investigate. That's kind of the situation that has been created by the smugglers and illegals. They can blame themselves; it's not the border patrol's fault that things are as complicated as they are when it comes to busting traffickers of all kinds.

"Unlawfully detained" given she was a large citizen and shouldn't have been detained. Her right were violated, not the least of which include ones related to being underage and held without access to family or a lawyer.

Did the officers in question know for certain that the parents were available? In smuggling cases, you can't exactly call the parents--and the 'parents' that might come in would be the exact person you don't want present during questioning.

Edit: Actually can you cite the federal law that prohibits questioning a child without a parent present? I'm not certain it's a crime.

Ya, Im not gonna teach you what a slippery slope is or how what you initially posted was a statement predicated on a slippery slope fallacy.

Just like Im not gonna go do your homework just because you insist on participating in a subject you have pretty much no knowledge whatsoever on.

For the record, since we know you aint gonna get off your ass and look, since the person in question is under 12 regardless of the crime she was being detained for she was legally able to be held for 6 hours before being charged or released. So even ignoring anything else about the situation what happened was illegal. Not even up for discussion.

So the answer to your other post is yes, it was illegal.

Youre still not understanding why its a fallacy, and thats okay, most people dont. Nothing that you said stops what you said from being one though. Its not about this occurs its about, I believe this will occur again. That seems to be the big hangup here.

As for the second question I dont know. If there is an exception its not one Ive ever seen referenced in any case nor come across myself.
