OBGYN here. A single night of 3-4 cocktails, especially outside of the embryogenic period, has not been proven to cause fetal alcohol syndrome, although there is no definitive data about exactly how much alcohol intake is associated with its development.

The US regulatory/standards of care organization is the American college of obstetrics and gynecology, and their stance is that since no data proves benefit, and there is a clear association with heavy, routine consumption, no alcohol should be recommended in pregnancy.

However, our friends in the UK have the royal college of obstetrics and gynecology, and they have a study or two floating around showing minimal maternal benefit with no proven fetal harm for 1-2 drinks per day.

Waitress should have asked the woman if she was pregnant, once confirmed she could refuse to serve her alcohol and not get into trouble.

If she had some ethical concern about serving the woman alcohol then she should have brought it up with her manager. She tried to dupe the customer and got caught.

And while I certainly understand and agree with her position, ultimately it isn't up to some random waiter to decide what is best for this woman's unborn child.

While it is totally reasonable for her not to want to serve a pregnant woman alcohol (I wouldn't either), you cannot change someone's order to something they didn't ask for. It violates the fundamental trust restaurants need to be a functioning business.

If she had concerns then she could talk to management and go from there.
