The pier has a "shallow water / no diving" sign (see pic). Defendant rented the condo out to the plaintiff and his guests. Plaintiff got drunk, and his other guests coaxed him (verbally) to enter the pool. At 1:20am, plaintiff dove headfirst into the pool, breaking his spine and left him quadriplegic.
