The Little Mermaid is essentially an animated remake of Splash, but with a redhead instead of a blonde. If you tried to make a Little Mermaid movie with a redheaded mermaid, you'd likely be sued for it. If nothing else was consistent with Disney beyond that, their lawyers would state that your mermaid was copying their copyrighted interpretation of said public domain character. Hell, they might even go as far as to sue someone for simply having a redheaded mermaid.
