31 y/o Dustin Cavanaugh, the Hagerstown man was found GUILTY but NOT criminally responsible on a charage he violated Maryland law by recording a telephone conversation without the other party's permission!!

He entered a NOT GUILTY PLEA with an agreed statement of facts to a charge of interception of communications. Once the plea was entered, Assistant State's Attorney Cyrus Jaghoory read the statement of facts in the case to the County Circuit Judge, Daniel P. Dwyer

Dwyer said there was sufficient evidence to find him guilty but a mental health determined he was not criminally responsible.

On Sept. 25, 2018, he called a Hagerstown Housing Authority official and later posted a recording on his Youtube page as Jaghorry told the judge they obtained a search and seizure warrant and confiscated his phone and other devices

The phone had a recording of the conversation with a housing authority as well as an app for recording calls

His public defense attorney, Carl Somerlock said Cavanaugh at times does not understand the consequences of his actions and other times doesn't understand the consequences and cannot sto himself due to his COMPULSION!!

He said "It's a compulsion you and i may never understand"

Maryland is an all party state which means all parties must grant permission to be recorded

Cavanaugh is on probation for an unrelated conviction in North Carolina as they have not determined if this verdict constitutes a probation violation

He has been held in the Detention Centre since March for violationg pre-trial supervision as the Maryland Dept of Health will have 50 days to evaluate him to determine if he's DANGEROUS

The sentencing was delayed until after the evaluation

After the hearing, his lawyer said Cavanaugh could be sentenced under supervision for 5 YEARS.

He can file an appeal up to 30 days after the sentencing

Another case was dismissed where he was charged for calling a pizza restaurant last year and recorded the conversation with an employee and posted it on his Youtube Page

My bigger issue is he'll not even be forced to get mental health treatment. No "he can be released on the condition that he'd supervised AND takes his medication"

In the legal world, it's not really seen as an "excuse". If someone is not competent to stand trial they absolutely should not be held to normal standards.

Aside from his pedo charge, most of his charges have been over recording, a right which only 11 backwards states don't allow.

Being able to record is to protect people. If they're wasting money trying to suppress that right, that's a problem taxpayers need to bring up with them to stop.
