No it's not. The UN tried to offer a compromise so that the Jews who were fleeing the Holocaust could have a state to call their own, but the Arab states refused and ended up declaring war on the Jews there. They lost twice, fair and square.

You don't need to play that card when both the League of Nations and the United Nations ratified Israel's right to exist after it was created due to the collapse of the Ottoman Empire following World War 1, and created by the British when they were legally given control of that land after the war. If religion should have nothing to do with it, then Israel still has a right to exist by Mandate of international law.

Do you know why Britain chose to create a Jewish state? It was because prior to that, they were attempting to manage the land by letting the people work it out, and people kept murdering the Jews so they figured coexistence wasn't going to work out for them.

I think you're missing the point of the conversation if you're trying to argue the "legal" standing for Israel to exist. i think generally the criticism of the UN partition plan should be much more focused on the concessions it gave to jewish minority communities in arab majority regions, rather than on its existence at all. the zionist community owned a significant majority of the land around tel aviv, and it was certainly entitled to become a separate entity from the palestinian majority.

a more fair plan would have created a much smaller israel with control of much less of the fresh water.

the problem is that plan would also have resulted in a declaration of war by the grand mufti of jerusalem. he was going to do that no matter the plan and had already initiated hostilities prior to the UN plan and Israel's public declaration of existence.

supporting him was somewhat of an obligaiton to his peers in the arab world; we sometimes overestimate their actual participation in the war. only syria and jordan were major participants. largely, the AI war was a defeat of jordanian and syrian regular forces and palestinian irregulars by the new israeli military.

the net territorial makeup of israel was likely going to be what it was pre-1967 regardless of the UN plan. it's tough to even fault a country for seizing territory in a defensive war, esp when you realize that any territory it didn't seize was annexed by the established nations that opposed it.
