More to the point, they're seldom capable of carrying them out. People who don't have guns or martial skill tend to talk a lot of BS, while people who can actually do damage prefer to keep their mouths shut.

Death threats should carry mandatory minimum jail sentences. Saying "omg, I wanna kill you right now" when somebody is being goofy or annoying shouldn't count, but if it's done to harass or intimidate somebody, lock 'em up. Not even for long. 30-60 days should be enough to scare most keyboard warriors, etc. into watching themselves. Ones that are beyond harassment and are going to be followed through with should obviously carry harsher punishments, but I think they already do anyway.
